1. Acceptance of Terms
Welcome to VeriCert@TechXplore. These Terms of Use constitute a legally binding agreement between you and TechXplore governing your access to and use of the VeriCert@TechXplore website and certificate generation services (collectively, the "Service").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
2. Description of Service
VeriCert@TechXplore provides a platform for creating, managing, and distributing digital certificates for conferences, workshops, training programs, and other events. Our Service allows users to:
- Create customized certificates with their own backgrounds, logos, signatures, and text
- Generate certificates in bulk for multiple recipients
- Distribute certificates via email
- Enable certificate verification through a unique verification system
- Download certificates as JPG files
3. User Accounts
3.1 Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. We encourage you to use "strong" passwords (passwords that use a combination of upper and lower case letters, numbers, and symbols) with your account.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3.3 Account Tiers and Limitations
Our Service offers different account tiers with varying features and limitations:
- Free Plan: 1 program and up to 25 certificates
- Premium Plan: Additional program with 100 certificates per program
- Bulk Plan: 5 additional programs with 100 certificates per program
You agree to abide by the limitations of your account tier. Attempts to circumvent these limitations may result in account suspension or termination.
4. User Content
4.1 Ownership
You retain all rights to any content you submit, upload, or display on or through the Service ("User Content"). By submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content solely for the purpose of providing and improving the Service.
4.2 Content Restrictions
You agree not to use the Service to create, upload, or distribute certificates or other content that:
- Is false, misleading, or deceptive
- Infringes on any patent, trademark, trade secret, copyright, or other intellectual property rights
- Violates the legal rights (including the rights of publicity and privacy) of others
- Is defamatory, obscene, offensive, hateful, or promotes discrimination
- Impersonates any person or entity, including official certifying bodies or educational institutions
- Contains software viruses or any other code designed to interrupt, destroy, or limit the functionality of any computer software or hardware
- Violates any applicable law, regulation, or these Terms
4.3 Certificate Accuracy
You are solely responsible for ensuring the accuracy and truthfulness of the certificates you generate. Certificates should not misrepresent qualifications, achievements, or affiliations. We reserve the right to remove any certificates that we believe, in our sole discretion, violate these Terms or may create liability for us.
5. Payments and Billing
5.1 Pricing
The pricing for our Service is listed on our website. We reserve the right to change our prices at any time. Any price changes will be communicated to you in advance and will apply to subsequent billing cycles.
5.2 Payment Methods
We currently accept payments through Google Pay (GPay). By providing a payment method, you authorize us to charge you for all fees associated with your account.
5.3 Billing Cycle
Our premium plans are billed on a per-program basis. Once purchased, the additional certificate allowance remains active until used, regardless of time elapsed.
5.4 Refunds
Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference.
6. Intellectual Property
6.1 Service Content
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of TechXplore and its licensors. The Service is protected by copyright, trademark, and other laws of both India and foreign countries.
6.2 Trademarks
The VeriCert@TechXplore name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of TechXplore or its affiliates or licensors. You must not use such marks without the prior written permission of TechXplore.
7. Limitations of Liability
In no event shall TechXplore, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
Our liability is limited to the maximum extent permitted by law.
8. Disclaimer of Warranties
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
9. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
